In accordance with Article 12 of the Law of Ukraine "On State Control over International Transfers of Military and Dual-Use Goods", Ukrainian business entities intending to carry out international transfers of goods, including intermediary (brokering) activities related to international transfers military goods, pre-registered as subjects of international transfers of goods by the central executive authority, implementing the state policy in the field of state exposition tnoho control.

According to the results of the preliminary examination in the field of state export control, the State Export Control Department identifies the goods, determines the conditions for the implementation of their international transfers, registers the entities and issues the relevant registration certificates, along with explanations on the conditions for the implementation of international transfers of identified goods.

Instruction on registration in the State Export Control of the subjects of entrepreneurial activity of Ukraine as subjects of implementation of international transfers of goods, approved by the order of the State Export Control Board dated 27.04.2009 No. 31, registered in the Ministry of Justice on July 15, 2009 under No. 637/16653.

Thus, in accordance with clause 2.5 of this Instruction, in the event of the introduction of changes in regulatory acts in the established order in the state export control, which result in corresponding changes in the name and description of the goods, the position (note) of the checklist or the conditions for the implementation of international transfers of goods, to explanation given to the subject, changes are made, which account for the relevant changes made by such a legal act, or a new explanation is issued.

In order to make appropriate changes in the clarification or registration of a new explanation, the entity carries out preliminary identification of the cooks, taking into account the changes set forth in the regulatory acts, and addresses the State Export Control.

Conduct the main examination, on the basis of which the subject obtains a corresponding permit, conclusion or international import certificate, which contains the amended regulations, the name and description of the goods, shall be made after making the appropriate changes to the explanation provided to the subject or the issuance of a new explanation and its receiving subject

Making the subject of a new clarification or amending the previously provided clarification, taking into account the above changes, is carried out by the State Export Control Board on the order of registration.

The Resolution of the Cabinet of Ministers of Ukraine dated January 11, 2018 No. 1 supplements the Procedure for exercising state control over international transfers of dual-use goods (hereinafter referred to as the Order). A single list of dual-use goods, and the lists appearing in Annexes 1 to 5 of the Order are excluded.

The said resolution will come into force on April 19, 2018. Prior to its entry into force, the lists of dual-use goods listed in Annexes 1 to 5 of the Order shall remain in force.

Therefore, the processing of applications for registration of subjects of international transfers of goods (for dual use goods) submitted to the State Export Control Board until April 19, 2018 is carried out in accordance with Annexes 1 to 5 of the Procedure.

Registration of subjects of international transfers of goods in accordance with the adopted Single List of goods dualuse, will be carried out in accordance with the applications, which will be submitted to the State Export Control since April 19, 2018.

In order to ensure timely filing from 19.04.2018 to the State Export Control of applications for registration of entities for the implementation of international transfers of goods in accordance with the Single List of dual-use goods, it is recommended that in advance, the identification of goods and preparation of documents necessary for the State Export Control of the preliminary examination in the field of state export control.
